Ocultar la patente ya no es delito. ¿Por qué cambió la norma?

La Ley del Tránsito ha sido modificada por la Ley 21.601, cambiando la sanción por ocultar la patente de un vehículo de un delito a una infracción. Esta reforma busca una respuesta más efectiva ante las infracciones que comprometen la seguridad vial.

Una nueva regulación pretende ser más efectiva para identificar y combatir este problema en el contexto de los delitos asociados a robo de vehículos u otros.

Gracias a la modificación de la Ley del Tránsito, específicamente el cambio introducido por la Ley 21.601, ocultar la patente de un vehículo dejó de ser considerado un delito. Ahora, esta acción se sanciona como una infracción, que podría llevar al retiro del vehículo o incluso a la suspensión de la licencia de conducir.

 

Anteriormente, los conductores que ocultaban las placas de sus autos y que podían ser sorprendidos gracias a sistemas de monitoreo vial, arriesgaban penas de presidio e inhabilitación de conducir.

 

Según el subsecretario de prevención del delito, Eduardo Vergara, estas medidas no se cumplían efectivamente. “La efectividad de esa pena era nula. Ahora, lo que tenemos es una herramienta para llevar adelante inmediatamente una infracción para retirar el vehículo o incluso avanzar en la suspensión de licencias”, explicó Vergara.

¿Cuál es la multa?

Con las nuevas regulaciones, los automovilistas que oculten sus patentes serán sancionados con multas que van desde 1 hasta 1,5 UTM, lo que equivale aproximadamente a entre $65.182 y $97.773 pesos. Esta misma sanción se aplicará a quienes cubran la placa o usen objetos para disminuir su identificación.

 

Adicionalmente, los vehículos involucrados serán retirados de circulación y trasladados a los corrales municipales. Los conductores deberán enfrentar estos cargos en el Juzgado de Policía Local de la comuna correspondiente, donde se les exigirá el pago de la multa.

 

Esta reforma busca mejorar la aplicación de la ley y garantizar una respuesta más efectiva ante las infracciones que comprometen la seguridad vial y facilitan la evasión de controles policiales y responsabilidades en accidentes.
